Terms and Conditions

Effective Date: September 30, 2025

Melaka Corp (주식회사 멜라카) ("Melaka", "we", "our", or "us") operates melaka.co.kr ("Service"). By using our AI content generation service, you agree to these Terms and Conditions.

If you do not agree, do not use our Service.

1. Definitions

  • Service: Melaka's AI content generation platform (images, videos, scripts, music)
  • Credits: Virtual currency used to generate content
  • User Content: Your prompts, inputs, and uploads
  • Generated Content: AI outputs created from your prompts
  • Personal Data: Information that identifies you

2. Eligibility and Account

2.1 Age Requirement

You must be at least 13 years old. Users aged 13-17 must have parental/guardian supervision.

2.2 Account Responsibilities

You agree to:

  • Provide accurate registration information
  • Keep your password secure
  • Not share your account
  • Accept responsibility for all account activity

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscription Plans and Credits

3.1 Plans

Available subscription tiers with varying credits and features.

3.2 Credits Policy

  • Credits are consumed when generating content (varies by type/quality)
  • Credits are non-transferable and have no cash value
  • Subscription Credits: Unused Credits expire at the end of each billing cycle (no rollover)
  • Top-up Credits: Available when your plan is out of credits. If you use all of your credits, or if you feel like you want more credits in the plan that you will use, you can get top-up credits which will be available for 1 month from purchase date

3.3 Automatic Renewal

  • Monthly plans: Renew on the same date each month
  • Yearly plans: Renew annually
  • You'll be charged at the then-current rate
  • You'll receive notification before renewal

4. Payment and Billing

4.1 Pricing and Taxes

  • Prices in KRW or USD
  • Exclusive of taxes (you pay applicable VAT and taxes)
  • Subject to change (notified in advance)

4.2 Payment Processing

  • Processed by third-party providers (Stripe, PayPal, Toss Payments)
  • You authorize charges for subscriptions and purchases
  • Failed payments may result in service suspension

5. Cancellation and Refunds

5.1 How to Cancel

Cancel anytime via:

Effect of Cancellation:

  • Monthly: Access continues until end of current billing cycle
  • Yearly: Access continues until end of annual period
  • Unused Credits are forfeited
  • No future charges

5.2 Refund Policy

All purchases are FINAL and NON-REFUNDABLE, except:

Exceptions (at our discretion):

  • Extended service outage (48+ hours)
  • Duplicate charges (payment processing error)
  • Billing errors (system error)
  • Fraudulent transactions (with proof)

Consumer Protection Rights:

  • Korean users: 7-day withdrawal right (if no Credits used)
  • EU users: 14-day withdrawal right (if no service used)

To request exception refund: Email fatih398@melaka.co.kr within 30 days with documentation.

6. Intellectual Property and Content Rights

6.1 Service Ownership

The Service, including all software, algorithms, designs, trademarks, and intellectual property, is owned by Melaka Corp.

6.2 Your License to Use Service

You receive a limited, non-exclusive, non-transferable license to use the Service for personal or business purposes. You may not:

  • Copy, modify, or reverse engineer the Service
  • Remove copyright notices
  • Develop competing products
  • Use bots or scrapers (except authorized API use)

6.3 Generated Content Rights

Free Plan:

  • You own the Generated Content
  • Personal use ONLY (no commercial use)
  • Cannot sell, license, or commercially exploit

Paid Plans (Basic, Creator, Pro Studio, Enterprise):

  • You own the Generated Content
  • Full commercial rights (sell, license, distribute)

All Plans:

  • You're responsible for ensuring content doesn't violate third-party rights
  • Generated content must not depict real individuals or use any person's likeness without explicit consent
  • Melaka retains license to use your content for AI training (see below)

6.4 AI Training (MANDATORY)

By using the Service, you grant Melaka a worldwide, royalty-free license to use your User Content and Generated Content to train and improve our AI models.

This is MANDATORY and you CANNOT opt out. If you don't agree, you cannot use the Service.

6.5 Responsible AI Use

Melaka Corp promotes safe and ethical AI use. Our AI systems are designed for creative, educational, and entertainment purposes only.

We prohibit the generation of deceptive or misleading content, including any material that could impersonate real individuals or infringe personal rights.

All generated outputs are fictional and intended for lawful, non-harmful uses.

7. Acceptable Use Policy

7.1 Prohibited Content

Our Service does not support or permit generation of realistic human faces, face swaps, deepfakes, or impersonations of real people.

You may NOT create content depicting or promoting:

Illegal & Harmful:

  • Illegal activities under Korean or local law
  • Child exploitation/abuse (ZERO TOLERANCE - reported to authorities)
  • Explicit sexual/pornographic content
  • Extreme violence or gore
  • Terrorism or extremism
  • Instructions for weapons, drugs, or dangerous activities

Harmful to Others:

  • Hate speech or discrimination (race, religion, gender, etc.)
  • Harassment, bullying, or threats
  • Doxing (sharing private info without consent)
  • Self-harm or suicide promotion

Deceptive & Fraudulent:

  • Deepfakes intended to deceive
  • Impersonation without disclosure
  • Misinformation to cause harm
  • Election manipulation
  • Spam or fake reviews

Rights Violations:

  • Copyright or trademark infringement
  • Privacy violations
  • Unauthorized use of others' likenesses

7.2 Prohibited Activities

  • Attempting to bypass content filters
  • Unauthorized access to accounts or systems
  • Service disruption or abuse
  • Multiple accounts for trial abuse
  • Fraudulent payment information
  • Reselling Service (Free Plan commercial use)

7.3 Enforcement

We may:

  • Remove violating content
  • Issue warnings
  • Suspend accounts (7-90 days, no refund)
  • Permanently terminate accounts (no refund)
  • Report illegal activity to authorities

8. Privacy and Data Protection

We collect and process personal data in accordance with GDPR, PIPA, and other applicable laws. Key points include:

  • We collect account data, usage data, and payment information
  • Your content WILL be used for AI training (mandatory)
  • Data is encrypted and stored securely
  • You have rights to access, correct, and delete your data (with legal exceptions)
  • We don't sell your data to third parties

AI Content Disclaimer:

  • AI outputs may be unpredictable, inaccurate, or biased
  • We don't guarantee quality, accuracy, or specific results
  • Generated content is NOT professional advice (legal, medical, financial, etc.)
  • You're responsible for reviewing content before use

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

10.5 Compliance Notice

Melaka Corp operates in compliance with global AI ethics and content standards. The Service strictly prohibits deepfakes, impersonations, or use of personal likenesses without consent.

We continuously review and filter content to ensure compliance with applicable regulations and partner policies.
